Seeds and Plants Tribunal

Establishment

The Tribunal is established under Section 28 of the Seeds and Plants Varieties Act Cap 326, Laws of Kenya.

Number of members of the Tribunal

• It is composed of the Chairperson, the Deputy-Chairperson and the members are selected from a panel of persons with a wide knowledge in the field of agriculture, horticulture or forestry, and a panel of persons who have a specialized knowledge of a particular species or groups of plants.

Quorum of the Tribunal

• The jurisdiction of the Tribunal shall be exercised by the Chairman and two other members selected from the panels.

Jurisdiction

It hears and determines complaints from any aggrieved persons in relation to;

• allow or refuse the grant of plant breeder’s rights;
• to cancel the grant of plant breeder’s rights;
• to cancel the grant of plant breeder’s rights;
• terminate an extension granted; and
• regarding compensation arising from seed production and sale.
