JSC statement on persons recommended to the President for appointment as Judges of the Court of Appeal

JSC STATEMENT. NAIROBI, JULY 22, 2019nnPreamblennThe Court of Appeal is established under Article 164 (1) of the Constitution. It has jurisdiction to hear appeals from the High Court, environment & Land Court, Employment& Labour Relations Court and any other court or tribunal as prescribed by an Act of Parliament. The Court has an establishment of 30 judges.nnOn 6^th August 2018, the President of the Court of Appeal placed a request before JSC to fill 11 vacancies in order to raise the number of judges from the current 19 to the full complement of 30 judges. Pursuant to Article 172 (a) whichnn nnmandates the JSC to “recommend to the President persons for appointment as judges,” the Commission obliged and declared 11 vacancies in the Office of the Judge of the Court of Appeal vide Gazette Notice No 1420 dated February 15, 2019.nnThe shortlisting and interview processnnFollowing advertisements of the vacancies placed in the Daily Nation and The Standard of February 22 2019, 113 applications were received from whom 35 candidates were shortlisted. The full list of applicants as well as the shortlisted candidates was once again published in the newspapers.nnThe Commission subsequently interviewed the 35 candidates in an exercise that was open to the public, including the media, from June 17 until June 27, 2019.  The Commission wishes to thank all the candidates who applied and particularly those who attended the interviews. Thank you too Kenyans for the feedback on the candidates, and all the organizations that participated in the vetting process.nn nn nnThe resultsnnAll the interviewed candidates performed very well.nnHaving deliberated and considered all the necessary parameters, the Commission has concluded that the following are the most suitable candidates to be recommended for appointment in accordance with Part III of the First Schedule of the Judicial Service Act.n
