Detention & custody

  1. If you are detained pending a trial, you have a right to a mention of your case after every two weeks.
  2. Whether you are in held in remand custody or imprisoned or sequestered for your own good, the law says that you retain all the rights and fundamental freedoms in the Bill of Rights, except to the extent that any particular right or a fundamental freedom is clearly incompatible with the fact that the person is detained, held in custody or imprisoned.
  3. Once you are detained or held in custody, a petition for an order of habeas corpus may be made in the High Court for you to be produced from that custody.
